The California Department of Technology released a report in May stating that none of the nearly 200 state agencies surveyed are using “high-risk” artificial intelligence systems. This finding has been met with skepticism, as it appears to contradict known uses of algorithmic decision-making in areas such as criminal justice and unemployment benefits. Under Assembly Bill 302 (AB 302), enacted in 2023, California mandates state agencies annually report their use of high-risk automated decision systems.
